Lietotāja profils tiek piesaistīts Lietotāja telefona numuram.Pēc profila izveidošanas un maksāšanas kartes piesaistes, Lietotājs var atslegt foodspot.lv iekārtu noskenējot QR kodu, kas atrodas uz iekārtas. Iekārta ir atslēgtam kad uz tās iedegās signālgaisma zaļā krāsā.

UZMANĪBU! No iekārtas atsēgšanas brīža līdz iekārtas durvju aizvēršanai, vai pirkuma apmaksai tiek veikts videoieraksts!Lietotājs var izvēlēties vēlamo preci, noskenējot ar aplikāciju preces svītrukodu, prece tiek pievienota pirkuma grozam. Ja preces svītrkods nevar tikt noskenēts vai atpazīts, šī prece nevar tikt pārdota, Lietotāja pienākums ir to novietot atpakaļ iekārtā. Informāiju par preces sastāvu, enerģētisko vērtību un tās sastāvā esošajiem alergēniem var nospiežot aplikācijā uz preces attēla.Kad Lietotājs ir izvēlējies un ieskenējis visas vēlamās preces, pārbaudījis preču cenas atbilstību cenrāžiem, kā arī paņemto preču daudzuma atbilstību pirkuma grozā norādītajam, Lietotājs veic pirkuma apmaksu, nospiežot taustiņu "PIRKT".Pēc veiksmīgas pirkuma apmaksas Lietotājs aizver iekārtas durvis un sagaida, kad iedegās sarkans signāls, kas apzīmē durvju slēgšanu.

1. Pakalpojuma lietošanas nosacījumi.

1.1. Foodspot.lv – sabiedrība ar ierobežotu atbildību "Interactive Media Spot", vienotais reģistrācijas numurs 40103438617, juridiskā adrese: Bramberģes iela 48, Rīga, Latvija, LV-1058.

1.2 Lietotājs – persona, kura noskenējot kodu uz Foodspot.lv iekārtas ir reģistrējusies Foodspot.lv tīmekļa lapā un izveidojusi savu profilu.

1.3 Iekārta - Foodspot.lv vitrīna vai kafijas automāts, vai mikromārkets, kas atslēdzams vai iedarbināms ar Foodspot.lv aplikācijas palīdzību.

1.4 Lietotājs, rīkojoties brīvi, pēc savas gribas un savās interesēs, savas tiesībspējas ietvaros, dod savu piekrišanu foodspot.lv viņa personas datu apstrādei foodspot.lv mobilajā vai tīmekļa lietotnē. Pirms lietotnes foodspot.lv lietošanas Lietotājam ir pilnībā jāizlasa šis Lietotāja līgums. Piekrītot šī Līguma nosacījumiem, Lietotājs dod piekrišanu viņa personas datu apstrādei. Lietotāja personas datu apstrāde tiek veikta saskaņā ar likumu un Eiropas Savienības Vispārīgās datu aizsardzības regulas Nr.2016/679.

1.5 Foodspot.lv var vienpusēji mainīt šo Līgumu bez iepriekšēja brīdinājuma. Šī Līguma jaunā redakcija stājas spēkā no tās ievietošanas brīža foodspot.lv aplikācijā, ja vien jaunajā Līguma redakcijā nav noteikts citādi.

1.6 Ar šo Lietotājs piekrīt šādu personas datu apstrādei:
- epasta adrese;telefona numurs;
- lietotāja OS tips un tā pašreizējā versija;
- pārlūkprogrammas veids un pašreizējā versija;
- tālruņa modelis un ekrāna izšķirtspēja; atrašanās vieta;
- avots, no kura Lietotājs ieradās vietnē (konkrēti, kura cita vietne vai reklāma);
- OS un pārlūkprogrammas valoda;
- darbības, kuras Lietotājs veic mobilajā aplikācijā Foodspot.lv;
- resursdatora IP adrese;
- bankas kartes numurs.

1.7 Foodspot.lvnesaņem un neglabā Lietotāja maksājuma kartes datus. Maksājumu pieņemšanu un transakciju norisi nodrošina maksājumu operātors Stripe, Inc.

1.8 Lietotājs piekrīt, ka pirkuma veikšanas laikā tiek veikts iepirkšanās procesa videoieraksts, kas pušu nesaskaņu gadījumā var tikt izmantots kā pierādījumi.Ja mēneša 1 kalendārā laikā puses nepaziņo par pretenzijām, ieraksts tiek dzēsts.

1.9 Ar datu apstrādi saprot jebkuru darbību (operāciju) vai darbību (operāciju) kopumu, kas tiek veikts, izmantojot vai neizmantojot automatizācijas rīkus ar personas datiem, tai skaitā: vākšana, ierakstīšana, sistematizēšana, uzkrāšana, uzglabāšana, precizēšana (atjaunināšana, mainīšana), salīdzināšana, iegūšana, izmantošana, nodošana foodspot.lv saistītajiem uzņēmumiem un/vai partneriem, depersonalizācija, bloķēšana, dzēšana, iznīcināšana.

2. Bonusi un maksājumi

2.1 Lietotājs maksā par savu pasūtījumu, izmantojot vienu no pieejamajiem maksājuma veidiem: ar VISA / MasterCard bankas karti, Apple Pay, Google Pay.

2.2. Ar šo Lietotājs piekrīt, ka foodspot.lv aplikācijā Lietotāja personīgajā kontā ieskaitītie bonusi nav uzskatāmi par naudas līdzekļiem, kā arī tie nav apmaināmi pret naudu vai pārvedami uz cita lietotāja kontu. Tie var tikt izmantoti tikai preču iegādei foospot.lv iekārtās. To vienīgais mērķis ir apmainīt pret precēm, uz kurām attiecas Lietotāja līguma noteikumi.

2.3 Foodspot.lv ir tiesības veikt akcijas, kurās Lietotājs var saņemt papildus bonusus vai atlaides (to skaitu, derīguma termiņu un citus nosacījumus nosaka foodspot.lv), ar nosacījumu, ka Lietotājam vispirms ir jāveic darbības, kas nepieciešamas, lai piedalītos šādas akcijas.

3. Lietotāja līguma atsaukšana

3.1 Šis Līgums ir spēkā no brīža, kad Lietotājs piekrīt Līgumam, līdz pieteikumam par šī līguma izbeigšanu.

3.2 Piekrišanu personas datu apstrādei Lietotājs var atsaukt, nosūtot Lietotāja parakstītu rakstisku paziņojumu foodspot.lv vai arī varat to nosūtīt no sava ierakstītā pasta ar piegādes paziņojumu uz foodspot.lv uz augstāk norādīto adresi.

3.3 Ja Lietotājs atsauc savu piekrišanu personas datu apstrādei, foodspot.lv ir tiesības turpināt tā rīcībā esošo personas datu apstrādi, ja tam ir attiecīgs tiesiskais pamats. Ja iestājas iepriekš minētie iemesli, Foodspot.lv pārtrauks Lietotāja Personas datu apstrādi un iznīcinās viņa Personas datus ne ilgāk kā trīsdesmit kalendāro dienu laikā no dienas, kad foodspot.lv saņem minēto atbildi.

4. Pušu tiesības un pienākumi

4.1. Foodspot.lv ir tiesības:- mainīt mobilās vai tīmekļa aplikācijas lietošanas noteikumus, kā arī mainīt šīs aplikācijas saturu. Šīs izmaiņas stājas spēkā ar brīdi, kad mobilajā aplikācijā tiek publicēta Līguma jaunā versija;- ierobežot piekļuvi mobilajai vai tīmekļa aplikācijai, ja Lietotājs pārkāpj šī Līguma noteikumus.- vērsties tiesībsargājošās iestādēs, ja Lietotājs nav veicis samaksu par iegādātajām precēm, bojājis preces foodspot.lv iekārtās vai bojājis pašas iekārtas.

4.2. Lietotājam ir tiesības:- iegūt piekļuvi mobilās vai tīmekļa lietojumprogrammas lietošanai pēc tam, kad ir izpildītas mobilās vai tīmekļa lietojumprogrammas prasības;- izmantot visus mobilajā vai tīmekļa aplikācijā pieejamos pakalpojumus, kā arī iegādāties jebkurus tajā piedāvātos pakalpojumus;- uzdot jebkurus jautājumus, kas saistīti ar mobilās vai tīmekļa aplikācijas pakalpojumiem, izmantojot mobilajā vai tīmekļa aplikācijā ievietoto informāciju;- izmantot mobilo vai tīmekļa lietojumprogrammu tikai šajā Līgumā paredzētajiem mērķiem un veidā, kas nav pretrunā tās valsts likumiem, kurā mobilā vai tīmekļa lietojumprogramma tiek izmantota

4.3. Lietotājs nedrīkst:- izmantot jebkādas ierīces, programmas, procedūras, algoritmus, metodes, automātiskās ierīces vai līdzvērtīgus manuālus procesus, lai piekļūtu mobilo vai tīmekļa lietojumprogrammu saturam, to iegādātos, kopētu vai pārraudzītu;- traucēt normālu mobilās vai tīmekļa lietojumprogrammas darbību;- jebkādā veidā apiet mobilās lietojumprogrammas navigācijas struktūru, lai iegūtu vai mēģinātu iegūt jebkādu informāciju, dokumentus vai materiālus ar jebkādiem līdzekļiem, kas nav īpaši paredzēti šīs mobilās vai tīmekļa lietojumprogrammas pakalpojumos;- veikt nesankcionētu piekļuvi mobilās vai tīmekļa lietojumprogrammas funkcijām un citām sistēmām vai tīkliem, kas saistīti ar šo mobilo vai tīmekļa lietojumprogrammu, kā arī jebkuriem pakalpojumiem, kas tiek piedāvāti mobilajā vai tīmekļa lietojumprogrammā;- pārkāpt drošības vai autentifikācijas sistēmu mobilajā vai tīmekļa lietojumprogrammā vai jebkurā tīklā, kas saistīts ar mobilo vai tīmekļa lietojumprogrammu.- veikt apgriezto meklēšanu, izsekot vai mēģināt izsekot jebkādai informācijai par jebkuru citu mobilās vai tīmekļa lietojumprogrammas lietotāju.- izmantot mobilo vai tīmekļa aplikāciju un tās saturu jebkādiem mērķiem, ko aizliedz tās valsts likumi, kurā mobilā vai tīmekļa lietojumprogramma tiek izmantota.

5. Atbildība

5.1 Foodspot.lv neatlīdzina zaudējumus, kas var rasties Lietotājam, tīši vai netīši pārkāpjot kādu šī Līguma noteikumu,

5.2 Foodspot.lv nav atbildīgs par zaudējumiem, ko Lietotājam radījušas trešās personas nesankcionēti pieklūstot Lietotāja profilam.

5.3 Foodspot.lv nav atbildīgs par:- jebkādu kavēšanos vai kļūmes operācijas veikšanas procesā, ko izraisījuši nepārvaramas varas apstākļi, kā arī jebkurā gadījumā problēmas, kas saistītas ar telekomunikācijām, datoriem, elektrību un citām līdzīgām sistēmām;- pārskaitījumu sistēmu, banku, maksājumu sistēmu darbības un jebkādi citi kavējumiem, kas saistīti ar to darbību.- mobilās aplikācijas pareizu darbību, ja Lietotājam nav tās lietošanai nepieciešamās ierīces;

5.4 Lietotājs ir atbildīgs par visiem zaudējumiem, ko tas radījis foodspot.lv tīši vai netīši bojājot foodspot iekārtas vai traucējot to normālu darbību, bojājot vai pasliktinot iekārtās esošo preču stāvokli, kā arī neveicot samaksu par visām precēm, kas paņemtas no iekārtas.

ATTENTION! A video recording is made from the moment of unlocking the device until closing the door of the device or paying for the purchase!The user can choose the desired product and add to shopping cart by scanning the barcode of the product with the application. If the product's barcode cannot be scanned or recognized, this product cannot be sold, it is the User's responsibility to place it back in the machine.Information about the product's composition, energy value and allergens in its composition can be found by clicking on the image of the product in the application.When the User has selected and scanned all the desired goods, checked the conformity of the price of the goods with the price lists, as well as the conformity of the quantity of goods taken with the one specified in the shopping cart, the User makes the payment for the purchase by pressing the 'BUY' button. After successful payment of the purchase, the User closes the door of the device and waits for the red signal to light up, indicating the closing of the door.

1. Terms of use of the service.

1.1. Foodspot.lv – limited liability company 'Interactive Media Spot', unified registration number 40103438617, legal address: Bramberges Street 48, Riga, Latvia, LV-1058;

1.2 User – a person who has registered on the Foodspot.lv web page and created his profile by scanning the code on the Foodspot.lv machine.

1.3 Equipment - Foodspot.lv showcase or coffee machine, or micromarket, which can be unlocked or activated with the help of the Foodspot.lv application.

1.4 The user, acting freely, according to his will and in his own interests, within his legal capacity, gives his consent to Foodspot.lv processing his personal data in the Foodspot.lv mobile or web app. Before using the Foodspot.lv app, the User must read this User Agreement in its entirety. By agreeing to the terms of this Agreement, the User gives his consent to the processing of his personal data. The processing of the user's personal data is carried out in accordance with the law and the European Union's General Data Protection Regulation No. 2016/679.

1.5 Foodspot.lv can unilaterally change this Agreement without prior notice. The new version of this Agreement enters into force from the moment of its placement in the foodspot.lv application, unless otherwise specified in the new version of the Agreement.

1.6 The User hereby agrees to the processing of the following personal data:
- E-mail address;Phone Number;
- the user's OS type and its current version;
- browser type and current version;
- phone model and screen resolution;location;
- the source from which the User came to the website (specifically, which other website or advertisement);
- OS and browser language;
- actions performed by the User in the Foodspot.lv mobile application;
- host IP address;
- bank card number.

1.7 Foodspot.lv does not receive or store the User's payment card data. Acceptance of payments and processing of transactions is provided by the payment operator Stripe, Inc.

1.8 The user agrees that a video recording of the shopping process is made during the purchase, which can be used as evidence in case of disagreement between the parties.If the parties do not report claims within 1 calendar month, the record is deleted.

1.9 Data processing means any action (operation) or set of actions (operations) performed with or without the use of automation tools with personal data, including: collection, recording, systematization, accumulation, storage, clarification (updating, changing), comparison, acquisition, use, transfer to Foodspot.lv affiliated companies and/or partners, depersonalization, blocking, deletion, destruction.

2. Bonuses and payments

2.1 The user pays for his order using one of the available payment methods: with VISA / MasterCard bank card, Apple Pay, Google Pay.

2.2. The User hereby agrees that the bonuses credited to the User's personal account in the Foodspot.lvapplication are not considered money, nor can they be exchanged for money or transferred to another user's account. They can only be used to purchase goods at Foodspot.lv machines. Their sole purpose is to exchange for goods subject to the terms of the User Agreement.

2.3 Foodspot.lv has the right to carry out promotions in which the User can receive additional bonuses or discounts (their number, validity period and other conditions are determined by foodspot.lv), provided that the User must first perform the actions necessary to participate in such promotions.

3. Withdrawal of User Agreement

3.1 This Agreement is valid from the moment the User agrees to the Agreement until the application for termination of this Agreement.

3.2 The User can withdraw consent to the processing of personal data by sending a written notice signed by the User to Foodspot.lv or you can send it from your registered mail with a delivery notice to Foodspot.lv to the above address.

3.3 If the User withdraws his consent to the processing of personal data, foodspot.lv has the right to continue processing the personal data it has, if there is a relevant legal basis for this. If the aforementioned reasons occur, Foodspot.lvFoodspot.lv will stop processing the User's Personal Data and destroy his Personal Data within no longer than thirty calendar days from the day when foodspot.lv receives the said response.

4. Rights and obligations of the parties

4.1. Foodspot.lv has the right:- change the terms of use of the mobile or web application, as well as change the content of this application. These changes take effect from the moment when the new version of the Agreement is published in the mobile application;- restrict access to the mobile or web application if the User violates the terms of this Agreement.- contact the law enforcement authorities if the User has not paid for the purchased goods, damaged the goods in foodspot.lv equipment or damaged the equipment itself.

4.2. The user has the right to:- gain access to use the mobile or web application after meeting the requirements of the mobile or web application;- use all services available in the mobile or web application, as well as purchase any services offered in it;- ask any questions related to the services of the mobile or web application using the information posted in the mobile or web application;- use the mobile or web application only for the purposes provided for in this Agreement and in a manner that does not conflict with the laws of the country in which the mobile or web application is used

4.3. The user may not:- use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, purchase, copy or monitor the content of mobile or web applications;- interfere with the normal operation of the mobile or web application;- bypass the navigation structure of the mobile application in any way to obtain or attempt to obtain any information, documents or materials through any means not specifically provided for in the services of this mobile or web application;- make unauthorized access to the functions of the mobile or web application and other systems or networks related to this mobile or web application, as well as any services offered in the mobile or web application;- violate the security or authentication system of the mobile or web application or any network connected to the mobile or web application.- reverse lookup, track or attempt to track any information about any other user of the mobile or web application.- use the mobile or web application and its content for any purpose prohibited by the laws of the country in which the mobile or web application is used.

5. Liability

5.1 Foodspot.lv does not compensate for losses that may occur to the User by intentionally or unintentionally violating any provision of this Agreement.

5.2 Foodspot.lv is not responsible for losses caused to the User by third parties unauthorized access to the User's profile.

5.3 Foodspot.lvis not responsible for:- any delay or failure in the process of carrying out the operation caused by force majeure, as well as in any case problems related to telecommunications, computers, electricity and other similar systems;- operations of transfer systems, banks, payment systems and any other delays related to their operation.- the correct operation of the mobile application, if the User does not have the necessary device for its use;

5.4 The user is responsible for all damages caused to Foodspot.lv by intentionally or unintentionally damaging foodspot equipment or interfering with their normal operation, by damaging or deteriorating the condition of the goods in the equipment, as well as by not making payment for all goods taken from the equipment."
